Ancient Temple in Japan Refuses Yakuza (ContributorNetwork)

COMMENTARY | Now the 1,200-year old Buddhist temple near Kyoto, Japan, has begun following orders from the Japanese police to refuse the yakuza from visits on its temple grounds. In the past they were allowed for members and their families to attend memorial services. Lately, police are trying to crack down on Japan’s most loathed and feared crime organization known as the yakuza. I’ve been to many temples in Kyoto, but not to Enryakuji. The part of Japan I lived in houses the largest yakuza clan called the Yamaguchi-gumi in Kobe. I lived in the same prefecture or state where Kobe is its state capital.

The irony is the yakuza do not advertise themselves out in public. What is known are their illicit activities. All over Japan you see pachinko parlors operated by the yakuza, even in the most remote villages possible. Pachinko machines are similar to slot machines in their addictive nature. Rarely does anyone win the grand jackpot. Even if they manage to win a substantial amount it is lost in a few more attempts. Their other activities, besides gambling, are prostitution, loan sharking and drugs. Tokyo and Osaka are the major cities for the yakuza.

One thing I learned immediately when I was living in Japan in the late 90s if you have tattoos you cannot enter a public swimming pool, bath house or gym. When I first arrived in Japan the hotel I stayed at in Tokyo had a pool for the guests. A group of foreigners informed some of my friends they wanted to go for a swim, but were turned away because of their tattoos. The yakuza wear a lot of elaborate tattoos all over their body, so you are considered engaging in or part of the criminal element in Japan. I do not have any tattoos, so this was not a problem. It was also during a time when wearing tattoos weren’t as popular as it is now.

At last the Japanese police are finally cracking down on the yakuza’s organized crime groups that number a total of 80,000 members overall. Most of the Japanese mom and pop type businesses have to pay a protection fee to the yakuza every month. Even though they’ve been tolerated in the past and revered in movies for so long hopefully it will all end soon.

STATE COLLEGE, Pa. (AP) ? Former Penn State coach Joe Paterno has a treatable form of lung cancer, according to his son.

Scott Paterno said in a statement provided to The Associated Press by a family representative on Friday that the 84-year-old Joe Paterno is undergoing treatment and that ?his doctors are optimistic he will make a full recovery.?

?As everyone can appreciate, this is a deeply personal matter for my parents, and we simply ask that his privacy be respected as he proceeds with treatment,? Scott Paterno said in a brief statement.

Scott Paterno said the diagnosis was made during a follow-up visit last weekend for a bronchial illness.

Earlier Friday, the Standard-Speaker newspaper of Hazleton, Pa., reported that Paterno had been seen Wednesday visiting the Mount Nittany Medical Center and was treated for an undisclosed ailment and released.

Paterno was fired last week in the aftermath of shocking allegations against former defensive coordinator Jerry Sandusky, charged with sexually abusing eight boys over 15 years. He initially announced his retirement effective the end of the season the morning of Nov. 9 before university trustees fired him about 12 hours later.

The lurid scandal tarnished the reputation of a football program that once prided itself on the slogan ?Success with Honor.? The Hall of Famer?s 409 career victories are a Division I record.

Police: 2 soldiers, child killed in north Nigeria (AP)

MAIDUGURI, Nigeria ? Police say two soldiers and a child are dead after members of a radical Muslim sect ambushed them in a city in northeast Nigeria.

Local police commissioner Simeon Midenda said Saturday that the attack happened Friday night in Maiduguri, the spiritual home for the sect known as Boko Haram. Witnesses said the sect members shot at a military patrol in the city, and one of the stray rounds killed a 9-year-old.

No one has been arrested over the killings.

Boko Haram is also being blamed for bombings and gunfights Nov. 4 that left more than 100 people dead in Damaturu, a town 80 miles (130 kilometers) west of Maiduguri.

The group has been carrying out a campaign of attacks for more than a year. Boko Haram wants the strict implementation of Islamic Shariah law across the country’s north.

Analysis: Emergency post-election measures won’t save Spain (Reuters)

MADRID (Reuters) ? Spain’s new government may rush through emergency measures immediately after Sunday’s parliamentary election, but unless the euro zone finds a durable systemic solution to its debt crisis, Madrid will still be forced to seek a financial rescue.

The center-right People’s Party, led by Mariano Rajoy, is expected to sweep to victory with a strong parliamentary majority on Sunday, giving it a solid mandate to deepen painful spending cuts and economic reforms.

While the new administration will not be sworn in until mid-December, analysts say Rajoy should be able to team up with incumbent Socialist Prime Minister Jose Luis Rodriguez Zapatero to announce contingency policies given the depth of the crisis.

Zapatero has cut costs and forced through economic reforms for more than a year — guaranteeing his party a loss at the polls — but investors have continued to dump Spanish debt regardless and borrowing costs are near-unaffordable.

Meanwhile, contagion from the euro zone debt crisis has spread to Italy and France, the currency area’s third and second largest economies, making Spain’s problems a small part of the wider problem.

“It depends on Italy, not on us. To ask about Spain doesn’t make a great deal of sense as the problem is out of our hands. It transcends to a much higher level,” Madrid-based financial analyst Juan Ignacio Crespo said.

Spain’s Treasury paid the highest rate since 1997 to sell a new 10-year bond on Thursday, just shy of the 7 percent level that forced Greece, Portugal and Ireland to apply for bail-outs.

At current financing costs, Spain would need a primary surplus of 1.8 percent to keep its ratio of debt to gross domestic product stable in the long term, according to calculations by Reuters Breakingviews. The country is forecast to run a primary deficit of 3.5 percent next year and its poor growth prospects mean it faces a struggle to get close to rubbing that out even years down the road.

NO WAY OUT

Italian Prime Minister Mario Monti, a technocrat who replaced former PM Silvio Berlusconi, said on Thursday that Italy faced a serious emergency which could help decide the future of the European Union.

Paris also paid markedly higher yields in a debt sale on Thursday and will soon be forced to show it is willing to make politically sensitive measures to defend its shaky AAA investment grade debt rating.

“You get to the point where even the countries doing the right thing, showing progress on structural reforms and fiscal deficits, cannot get any traction with the markets because the market is closed to the periphery in general,” Deutsche Bank economist Gilles Moec said.

“That the governments do their bit is a pre-requisite, because it’s what warrants support from the other Europeans and the ECB. But it isn’t sufficient.”

Zapatero reversed his previous economic stimulus policy at the beginning of 2010 with spending cuts worth around 5 percent of GDP in an effort to bring down one of the euro zone’s highest public deficits.

By doing its homework, Spain staved off the immediate need for a bailout — the size of which would test EU political will and the capacity of the economic safety net, the European Financial Stability Facility, or EFSF.

But it’s increasingly clear it has been too little, too late, much to the frustration of Spaniards who are likely to suffer even deeper cost cutting under Rajoy.

“Spain is like a patient in the hospital. We’re anxious they get back to work, but they need a period of recuperation first,” economist at the Spanish business school IESE Antonio Argandona said.

Rajoy will inherit a very troubled economy, which as elsewhere calls into question whether the strategy of eye-watering austerity leaves any chance of the growth needed to pay off the country’s debts.

Spanish unemployment is more than double the EU average at 21.5 percent, with almost half of young people out of work. The economy stagnated in the third quarter and is widely expected to slip into recession by the end of the year.

Burdened by resulting low revenues, analysts polled by Reuters expect the government to miss the public deficit target of 6 percent of gross domestic product this year by a wide margin.

While Rajoy will likely scramble next week to prove his resolve to nervous investors, all efforts will be met with cautions skepticism perhaps forcing him to face the nuclear option Zapatero avoided, an appeal to Brussels and to the International Monetary Fund.

“The only emergency measure left is to apply for an EFSF/IMF credit line. It would be horrible for Rajoy to have to do that as a first step, but Zapatero would not stand in his way,” said Antonio Barroso, economist for Eurasia Group.

Five players fined from spiteful Lions v Bears clash (Reuters)

(Reuters) ? Detroit Lions quarterback Matthew Stafford and five other players were fined a total of $62,500 for incidents in Sunday’s ill-tempered game between the Lions and Chicago Bears, the National Football League (NFL) said on Friday.

Stafford was fined $7,500 for unnecessary roughness after he grabbed Bears defensive back D.J. Moore by the helmet in the fourth quarter, an NFL spokesman told Reuters.

Moore drew a $15,000 fine for striking Stafford in retaliation. He also was ejected from the game, won 37-13 by the Bears.

Detroit defensive tackle Nick Fairley was also docked $15,000 for unnecessarily driving Bears quarterback Jay Cutler to the ground.

Guard Rob Sims and defensive end Kyle Vanden Bosch of the Lions were each fined $7,500 for striking an opponent late, and Bears receiver Earl Bennett was assessed a $10,000 fine.

His infraction? For the second time this season, he wore dominantly orange shoes, a uniform violation, the NFL said.

“I asked (team mates) ‘Should I wear the orange shoes again?’” Bennett told reporters.

“One of them (team mates) was like ‘most definitely, I’ll take care of it.’ So that’s how it went down,” Bennett said.

He was fined $5,000 for the first violation.

Amazon still fighting off Apple over ?app store? trademark (Appolicious)

Despite protests from just about everybody else in the mobile sphere, Apple has trademarked the term ?App Store? for its iTunes App Store. And since Amazon calls its Android app sales portal the ?Amazon Appstore,? Apple has been trying to fight it in court since March.

According to a new story from GigaOM, Apple has amended its complaint against Amazon to include false advertising in addition to trademark infringement. Already, the complaint claims that Apple?s iOS mobile operating system brand is synonymous with the words ?App Store,? and so allowing Amazon to use it creates confusion among the public and hurts Apple?s brand and sales.

The harm Apple is describing is directly related to the kind of business Amazon runs with the Appstore. Apple says that while it tightly controls its own iTunes App Store to make sure only quality apps make it in (itself a debatable assertion), Amazon doesn?t do as much to guard users against things like malware or the misappropriation of user data. And that lack of quality control can damage Apple?s brand by association through the use of the words ?App Store.?

Meanwhile, Amazon (and Microsoft and Google) argue that ?app store? is actually a generic term for any app distribution portal online, and that Apple can?t patent such generic phrasing. Amazon also responds that, given that the Amazon Appstore is for Android devices and Apple?s is for its own iOS devices, there?s no harm done for Amazon using the term, and Apple couldn?t prove that it?s being harmed by the use of the words anyway.

The false advertising accusation from Apple is derived from the Amazon Kindle Fire. According to Apple?s filing, Amazon has de-emphasized the Android identifier with its ads for the bargain-priced tablet. Without the Android moniker, Apple claims, there?s even more possibility of confusion between ?App Store? and ?Appstore.? Here?s a quote from the filing from GigaOM?s story:

Amazon’s use is also likely to lessen the goodwill associated with Apple’s App Store service and Apple products designed to utilize Apple’s App Store service by associating Apple’s App Store service with the inferior qualities of Amazon’s service.

Ouch.

But Apple?s claim is probably already on thin ice. Back in July, District Court Judge Phyllis Hamilton, who is presiding over the case, said that Apple is struggling to provide ?real evidence of actual confusion? over the two brands among consumers. Hamiton said she would probably deny Apple?s motion based on that lack of evidence, and that she?ll be reviewing the court findings before making her final decision.

It?s worth noting that the Kindle Fire, which is available right now, is seen to pose a significant threat to the tablet market ? although maybe not to the iPad so much. But with its $199 price tag, it undercuts most of the market pretty deeply, and that makes it about $300 cheaper than the cheapest iPad. That might be something Apple is thinking about when it comes to these fights over app stores.

Democrats, Republicans far apart on deficit deal (AP)

WASHINGTON ? The top Republican on a special deficit-cutting panel says GOP negotiators have “gone as far as we feel we can go” on tax hikes, a public signal that a debt bargain could be out of reach despite weeks of negotiations.

Texas Rep. Jeb Hensarling told CNBC Tuesday that the bipartisan debt supercommittee is “somewhat stymied for the moment” because panel Democrats are insisting on tax increases of up to $1 trillion in exchange for cost curbs on rapidly spiraling benefit programs such as Medicare and Social Security.

The top Democrat on the deficit supercommittee, Sen. Patty Murray of Washington, countered that it’s up to Republicans to send a “credible offer with real revenue” to jump-start talks that seem to have mostly stalled since a swap of offers last week.

The deficit for the just-completed budget year was $1.3 trillion, requiring the government to borrow 36 cents for every dollar it spends. Even a successful negotiation that produces $1.2 trillion in cuts will still leave a deficit crisis that requires painful choices by policymakers on taxes and benefits programs, budget experts agree.

The backbiting has intensified since the exchange of offers. The Democrats’ most recent plan called for $2.3 trillion in deficit cuts, including a $1 trillion tax increase over the coming decade. Republicans countered with almost $300 billion in new tax revenues as part of a $1.5 trillion debt plan, an offer that even a top Democrat, Majority Whip Dick Durbin of Illinois, called a breakthrough.

“The Democrats won’t put a plan on the table to solve the problem, and anything they do that even remotely addresses health care, even superficially, they’re insisting on” a $1 trillion tax increase, Hensarling said. “It’s not going to happen.”

The debt panel is charged with coming up with at least $1.2 trillion in deficit cuts over the coming decade as part of a bargain between President Barack Obama and House Speaker John Boehner, R-Ohio, this summer. Failure would trigger across-the-board spending cuts that especially alarm defense hawks.

Boehner publicly blessed the GOP offer on taxes Tuesday, bucking opposition by some GOP presidential hopefuls and colleagues wary of violating a longstanding point of party orthodoxy.

The supercommittee has until a week from Wednesday to vote on any compromise, but several officials said that in reality, perhaps as little as 48 or 72 hours are available to the six Republicans and six Democrats.

While Boehner’s voice is important, his endorsement does not mean all Republicans will follow him or a deal is in sight. Republicans have been unified for two decades in opposition to higher taxes, while Democrats on the supercommittee insist on additional revenue before they will agree to cuts in benefit programs as part of a compromise.

Boehner said the plan, outlined a week ago to Democrats on the committee, was “a fair offer.” Adding an overhaul of the federal tax code would generate economic growth, he said.

The full committee hasn’t met in several days, but various subgroups have been in near constant contact.

More than deficit reduction is at stake, one year into an era of divided government.

Democrats are hoping to add elements of President Barack Obama’s jobs legislation to any deficit-cutting deal, including extensions of a Social Security payroll tax cut and unemployment benefits that are due to expire at the end of the year. But their proposal to use savings from shrinking war spending is opposed by some Republicans.

A comprehensive rewrite of farm programs may hang in the balance, too, and lawmakers also must pass legislation to ensure sufficient funds to reimburse doctors who treat Medicare patients.

The twin issues of taxes and benefit programs have long been stumbling blocks in budget negotiations.

In negotiations last summer, according to numerous officials, Obama and Boehner were considering sizable cuts to benefit programs as well as tax reform that would have raised as much as $800 billion in additional revenue. The talks ultimately failed.

Republican leaders still support the concept of swapping modest tax increases for a tax overhaul. And they say that’s a good deal, especially since the Bush-era tax cuts expire at the end of next year.

“It’s important for us to, in my opinion, reform the tax code,” Boehner said. “And we’ve got the highest business tax rate in the world. We’ve got a personal tax system that’s so complicated it costs Americans about $500 billion a year to comply with the current tax code,” he said.

Republican officials say the GOP offer envisions an overhaul that would drop the top tax rate on personal income to 28 percent from the current 35 percent and shave or eliminate some itemized deductions that are commonly used. The top corporate rate would fall also.

Despite Boehner’s comments, GOP presidential contenders Newt Gingrich and Rick Perry said they were prepared to oppose a plan along the lines of the one under consideration. Another candidate, Mitt Romney, brushed aside a question on the subject.

A music store isn’t much without plenty of music, and Google’s new offering launched with some big backing today. The company is partnering with Universal, EMI, Sony Music and no less than 23 independent labels on the service — according to Google, that covers about 13 million songs in total, 8 million of which are available today. Speaking at the launch event, Universal’s Rob Wells said that he expects Google Music to be a “rich new revenue stream for our artists,” and further noted that he’s excited about the “global rollout” across all Android devices, although we’re unfortunately not hearing many specifics about availability outside the US just yet. What’s more, Google also announced that Google Music will have a number of exclusive offerings from the labels, including concerts from the likes of The Rolling Stones, Coldplay, Pearl Jam and The Dave Matthews Band, and the exclusive debut of Busta Rhymes’ latest album.
